This policy has been updated in response to Public Chapter 233, which expands the ways citizens may submit open records requests and allows LEAs to deny requests based on the citizen's failure to comply with the policy.

4. 2.703 Audits

Rationale:
Public Chapter 383 requires that LEAs with findings in their annual audit submit a corrective action plan to the comptroller of the treasury. This plan must include the name(s) of the contact person responsible for the corrective action, the action taken or planned, and the anticipated completion date.

6. 3.400 Student Transportation Management

Rationale:
The major revision of this policy reflects mandatory changes required by Public Chapter 289. This new law requires that every LEA appoint a transportation supervisor who meets certain training requirements, and adopt a policy that governs how safety complaints will be submitted. It also contains requirements on how investigations of those complaints will occur.

This policy has been updated in response to a change in State Board Policy 2.103. Students who pass credit recovery courses are now required to receive a grade of 70%.

8. 4.301 Interscholastic Athletics

Rationale:
Public Chapter 260 requires that students be excused from participating in a school athletic event, or related event, if the event is on an official school holiday, observed day of worship, or religious holiday.
We confirmed with TSBA that this does not include breaks, such as Fall and Spring Break or Christmas Break.

9. 4.402 Selection of Instructional Materials (Other than Textbooks)

Rationale:
State law no longer requires a portion of individual teacher instructional supply funds be pooled with all such funds and spent as determined by a committee. Under this new law, each teacher will individually be given $200 total and will be able to decide how to best use the full amount. TSBA recommends deleting this policy. |

Rationale:
State Board of Education Policy 3.301 now requires that LEAs that offer honors courses and postsecondary opportunities adopt a policy providing for additional weighting of these courses. TSBA has updated our policy 4.600 to include this weighting information.

TSBA updated this policy in response to Public Chapter 287. Previously, retired teachers could substitute teach for 120 days without loss of retirement benefits, and an addition 90 days if the director of schools certified in writing that no other qualified personnel are available to substitute teach. This new law removes the 90 days limit on those additional days. As a result, retired teachers may now substitute teach beyond 120 days provided the director of schools still certifies in writing that no other qualified personnel are available.

Rationale:
This is a new policy that limits the information that may be provided to assist an LEA's employee or contractor in obtaining a new position if the person engaged in sexual misconduct with a minor. LEA staff may still transmit administrative and personnel files on behalf of the employee or contractor, but may not aide such persons in obtaining another position by other means. This federal law is aimed at preventing LEA administrators from giving a neutral or positive recommendation to a potential employer on behalf of the employee or contractor if there is probable cause to believe that sexual misconduct occurred.
