C.1.a. Rejection of all proposals submitted in response to RFP 026-20 for Cellular Data Services.
Rationale:
Staff recommends that all proposals submitted in response to RFP 026-20 for Cellular Data Services be rejected. Staff will be in a position after a period of usage to better evaluate the District’s data and service needs. Staff will determine in the next 6 months whether to recommend an RFP for next year. In the meantime, staff is separately recommending that the District take advantage of terms for cellular data services previously negotiated by the State of Nebraska.

C.1.b. Approval of Agreement with T-Mobile for unlimited 4G LTE data services for 56,400 iPads and 300 mobile hot spots.
Rationale:
Staff recommends approval of the attached one year agreement with T-Mobile USA, Inc.("T-Mobile") to provide the District with unlimited 4G LTE data services for 56,400 iPads. 2000 iPads will be activated in June for summer school. The remaining 54,400 iPads will be activated in August. The rate is $15.84 per month per iPad. The total monthly cost for all iPads is $893,376.00. The total annual cost is $10,720,512.00. In addition, T-Mobile will provide the District with 300 mobile hotspot devices at a cost of $20.00 per month, which includes both the device and the data service. The total monthly cost for the mobile hotspots including data service is $6,000.00. The total annual cost of the mobile hotspots including data service is $72,000.00. The total one year cost of the proposed agreement for both cellular data service for iPads and for mobile hot spots is $10,792,512.00. The monthly price per device is valid through December 31, 2020, and the monthly price per devise for the District for the balance of the term will automatically be adjusted to reflect the new rate negotiated by the State of Nebraska. As such, the amount of the per device charge could change beginning on January 1, 2021 which would then change the amount paid by the District from the amounts shown above. In keeping with the provisions of Policy 7000, Section V, the bidding requirements are being waived because the District is taking advantage of the terms of a cooperative purchase state bid contract entered into between the State of Nebraska and T-Mobile.

D. Request for Closed Session
Rationale:
The Omaha Board of Education is authorized by state statute to hold closed sessions. Closed sessions may be held when clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual. Reasons that meet this standard include but are not limited to: (a) strategy sessions with respect to collective bargaining, real estate matters, pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body; (b) discussion regarding deployment of security personnel or devices; (c) investigative proceedings regarding allegations of criminal misconduct; (d) evaluation of the job performance of a person when necessary to prevent needless injury to the reputation of a person and if such person has not requested a public meeting; and (e) legal advice.
Explanation
At this point, it is appropriate for the Board to meet in closed session for one of the stated matters and/or any other permissible closed session matters in compliance with the law. That the Board hold a closed session: 1. For strategy session with respect to negotiations/collective bargaining clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law. 2. For strategy session with respect to property/real estate matters clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
3. For strategy session with respect to pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
4. For discussion regarding deployment of security personnel or devices clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
5. For investigative proceedings regarding allegations of criminal misconduct clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
6. For personnel and the evaluation of job performance clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
7. For discussions of the legal consequences of specific action and legal advice clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law. |
