November 20, 2023 at 6:30 PM - 2nd Council Regular Meeting

1. Mayor Bergman calls City Council meeting to order, with the "Pledge of Allegiance" and the "Open Meeting Statement" as required by NE State Statutes 84-1407 through 84-1414; Mayor Bergman also states that the City Council may vote to go into Closed Session on any agenda item as allowed by NE State Statute 84-1410.

4. Chief of Police Dan Howard presented Malik Bearheels (Part-time City Police Officer) a "Life Saving" award regarding a vehicle accident.

5. Mayor Bergman opens Public Hearing regarding the Final Plat of Dugan's (Tyler & Kimberly Dugan) Subdivision located at the southeast corner of 14th Avenue and Inman Road, Howard County, Nebraska (within the City's one-mile extraterritorial jurisdiction).  The property is more legally described as: Part of the North Half of the Northwest Quarter (N1/2, NW1/4), West of the Ord Branch of the Union Pacific Railroad, of Section 34, Township 15 North, Range 10 West of the 6th P.M., Howard County, Nebraska.  The calculated area is 19.89 acres. 

6. Discuss - Approve / Deny Olsson's "Letter Agreement for Professional Services regarding the Consulting Services Agreement 2024".  Olsson's Street Superintendent Services will not exceed $3,000 in cost and the Consulting Services Projects will not exceed $5,000 in cost.

7. Discuss - Approve / Deny St. Paul Museum of NE Major League Baseball organization updating/renovating the Grover Cleveland Alexander Field baseball sign (Loren Studley).

8. 9. Discuss - Approve / Deny Certificate of Approval of Dugan's Subdivision located in a part of the North Half of the Northwest Quarter (N1/2, NW1/4), West of the Ord Branch of the Union Pacific Railroad, of Section 34, Township 15 North, Range 10 West of the 6th P.M. in Howard County, Nebraska.

10. Discuss - Approve / Deny Zoning Permit #2023-45; City of St. Paul "Welcome" monument sign on US Highway 281 between US Highway 92 and "O" Street. The City Planning Commission denied the permit, due to it not meeting the required setbacks on the east and west sides (Zoning Administrator Matt Helzer).

11. Discuss - Approve / Deny Consent Agenda Items: (1) Treasurer's Report October 2023; (2) November 6, 2023 (regular) Council minutes and November 7, 2023 (special) Council minutes; (3) November 20, 2023, disbursements; and (4) November 13, 2023, zoning permits.

12. Introduce Ordinance #1042; re-zoning of real property in the City of Saint Paul, Howard County, Nebraska on a Tract of Land comprising of Lot One (1), Paul's North Subdivision in Howard County, Nebraska, to change the Zoning Map and Comprehensive Plan of the City of Saint Paul, Nebraska in conformity with said change; and to provide for an effective date (Effective Date December 14, 2023).
***Introduce Ordinance with No Second and No Roll Call;
***Waive three (3) Readings of Ordinance on three (3) different occasions, with Second and Roll Call;
***Final Passage of Ordinance, with Second and Roll Call.

13. Discuss - Approve / Deny transferring $100,000 from the Sales Tax Money Market account to the Sales Tax Checking account RE: the transferring of monthly funds for the Street Motor Vehicle Tax; 25% Infrastructure; and the Fire Station sales tax. 

14. Discuss - Approve / Deny advertising with the previous approved bid specs regarding a new or used Light Department bucket truck (Electrical Commissioner James Summers).

15. Discuss - Approve / Deny abatement of property at 304 8th Street (Eiberger) - Chief of Police Dan Howard.

(1) Nuisance & Incident Report;

18. Mayor Bergman updates:
(1) Certificate of Deposits #109366 ($64,424.11) and #109367 ($64,412.50) were cashed and deposited into the General Insured Cash Sweep (ICS) accounts to receive a higher interest rate;
(2) City of St. Paul Firefighter and EMT Roster (Dan Howard and Malik Beerheals went from EMT's TO Drivers); 
(3) State and Local Fiscal Recovery Funds: Recipients MUST obligate SLFRF funds by December 31, 2024, and expend obligated funds by December 31, 2026;

20. Closed Session: The City of St. Paul reserves the right to go into Closed Session when it is clearly necessary to protect the public interest or for the prevention of needless injury to the reputation of an individual; or pending litigation

(1) Certificate of Deposits #109366 and #109367 were cashed and deposited into the General Insured Cash Sweep Accounts to receive a higher interest rate;
(2) Receipts October 2023;

23. This agenda, including supporting documentation, is available for public viewing during normal business hours at the City Office, 704 6th Street, St. Paul, Nebraska.

The Mayor and City Council reserve the right to enter into an Executive Session at any time during the meeting, in accordance with the Nebraska Open Meetings Act, even though the closed session may not be indicated on the Agenda.
It is the intention of the Mayor and City Council to take up the items on the agenda in sequential order.  However, the Mayor and City Council reserves the right to take up matters in a different order to accommodate the schedules of the City Council members, person(s) having items on the agenda, and the public.  The City of St. Paul reserves the right to adjust the order of items on the agenda.
