November 3, 2015 at 7:00 PM - Crete City Council Regular Meeting

Rationale: 

    The City Council has posted a copy of the Open Meetings Act, Laws of the State of Nebraska, in the back of the council chambers.  Additional copies are available to read, if anyone wishes one during this meeting, please advise. 
    As each agenda item is considered, if there are any questions concerning the agenda item please advise.  The City Council may consider items listed on the agenda in random order.
    The City Council has assisted listening devices available, if needed please advise.

Rationale: 

    Attendance of Council members will be recorded to determine the presence of a quorum for official actions.

Rationale: 

    No action can be taken by the council on matters presented under this title except to answer any question posed and/or to refer the matter for further action.  Testimony may be limited to 3 minutes per person.  Please do not repeat testimony that has already be heard.

Rationale: 

    The council may take action to hear testimony in favor of  or in opposition to, discuss/limit  discussion and take action to approve or disapprove any matter presented under this title.

Rationale:  A public hearing to hear comments in favor of and/or in opposition to the annexation of property on the east side of Highway 103 south of city limits

Rationale:  A public hearing to hear comments in favor of and/or in opposition to a zoning change of recently annexed property south of Schwan's on Highway 103 from A-1 to I-1

Rationale:  A public hearing to hear comments in favor of and/or in opposition to amendments to 11-306 completing the last sentence of number 2. in paragraph N.

Rationale:  Dennis and Charlotte James would like to subdivide their property, (the south 18.5 feet of Lot 3 and all of Lots 4-6, Block 196) into 2 tracts

Rationale:  SENDD has received approval of the changes to the guidelines as presented and approved by the City Council September 15, 2015, but DED made some other changes that they are requiring the City Council to approve.

Rationale:  The Public Works Committee has reviewed an agreement to provide engineering services related to Crete Core Ingredients

Rationale:  The Public Works Committee has reviewed an agreement to provide engineering services related to the Transportation Alternatives Program Trail grant application

Rationale:  An agreement to provide engineering services to provide for utility extensions out of the new WWTP to the annexed property to the north

Rationale:  A change order to address power supply and industrial utility extensions to the north

Rationale:  The Finance Committee reviewed renewal quotes for the employees dental insurance as provided by Benefit Management

Rationale:  A correction to the December 16, 2014 FOP Agreement Article 14 - Holidays as presented by Mayor Foster

Rationale:  The Mayor would like to hold an employee appreciation event on December 4th at 4:00 PM.

Rationale:  The Mayor would like to appoint Larry Eberspacher to the Cemetery Board replacing Leonard Kohl for a term of 6/1/2017

Rationale: 

    The Council may take action to hear testimony in favor of or opposition to, discuss/limit discussion and take action to approve or disapprove any matter presented under this title. The Council may take action to waive the statutory rule requiring reading on three separate dates on any ordinance being considered. The Council may take action to pass and approve any matter presented under this title.

Rationale: 

A resolution that:

- approves payment of matching funds by the City

- approves the contractor selected for construction of the bridge

- approves plans and specifications used for bidding

- authorizes the Mayor to sign the contract

Rationale:  The Public Safety Committee has reviewed property of the Police Department

Rationale:  An ordinance to annex property adjacent to Lot 1, Cerny-Hancock Subdivision, on petition of the owners

Rationale:  An ordinance amending City Code 1-326; Appointed Officials; Fire Chief

Rationale:  An ordinance approving the annexation of 3 tracts of land on the eastside of State Highway 103 south of the city limits

Rationale:  An ordinance changing the zoning of property recently annexed south of Lot 1, Cerny-Hancock Subdivision, from A-1 to I-1

Rationale:  An ordinance amending City Code 11-306, completing a sentence in number 2. of paragraph N.

Rationale:  The Finance Committee has reviewed amending the occupation tax code to match state on liquor license and to increase fireworks stand fees

Rationale: 

    Reports may be given by Department Heads, Committees and Council members concerning current operations of the City. Questions may be asked and answered. No action can be taken by the Council on matters presented under this title except to answer any question posed and to refer the matter for further action.

Rationale: 

    Council will consider approval of the following items. Explanation may occur for each item and the council may approve and or amend and approve the items listed.

Rationale: 

    The city council will review the above matters and take such actions as they deem appropriate. The city council may enter into closed session to discuss any matter on this agenda when it is determined by the council that it is clearly necessary for protection of the public interest or the prevention of needless injury to the reputation of an individual and if such and individual has not requested a public meeting, or as otherwise allowed by law. Any closed session shall be limited to the subject matter for which the closed session was called. If the motion to close passes, then the presiding officer immediately prior to the closed session shall restate on the record the limitation of the subject matter of the closed session.
