Rationale:
The Nebraska Art Teachers Association has named Shelby Rix the 2021 Nebraska Middle School Art Educator of the Year. The mission of the Nebraska Art Teachers Association is to advocate for and advance art education in Nebraska to fulfill human potential and promote global understanding. Rix has proven herself as an advocate for art education who strives to help students reach their full potential.
EXPLANATION: Mickle Middle School Instructional Coordinator Jason Brunott said this about Rix: "Shelby strives to do her best as an art educator and challenges her students to reach their full potential. Her willingness to take suggestions, modify lessons and experiment with new strategies demonstrates her motivation and growth related to teaching and learning. Shelby takes pride in teaching the visual arts. She exhibits a growth mindset, as she is always looking to improve lesson design and instruction. Ultimately, she consistently provides opportunities for students to enjoy and focus on the journey through the art-making process." Lorinda Rice, art curriculum specialist for Lincoln Public Schools, said the following about Rix: "In addition to her own responsibilities as an art teacher, she works with other art teachers to fully integrate art in the planning and implementation of art-based inquiry and integration. She collaborates with others to find ways to support students' entry into art-making as meaning making. Most importantly, she serves as a role model to students. Her continual enthusiasm, energy and care help to maintain a non-threatening atmosphere in which all students feel comfortable participating in art." |

The Human Resources Division also includes the Office of Risk Management. As such, in addition to the Lincoln Board of Education approving all contractual agreements with employees, all employee benefit issues, all personnel actions, and all other matters within the scope of the Human Resources Division, as part of the Human Resources Matters agenda; the Lincoln Board of Education also must approve the settlement of Workers’ Compensation claims, take action on tort claims filed against the district, and take action on all other matters within the scope of the Office of Risk Management.

8.3. Option Enrollment Student Application for 2021-22
Rationale:
On February 9, 2021, the Board adopted a resolution to accept option enrollment students for the 2021-22 school year. An application for enrollment during the 2021-22 school year has been received and is in compliance with the Board resolution of February 9, 2021.
Explanation The application included in this agenda item has been examined by staff and meets one of the criteria set forth by the Board in the resolution of February 9, 2021. Staff recommends approval of the application. Proposal That the Board adopts the following resolution: WHEREAS, the student who has been assigned student number 433878 (for purposes of confidentiality, assigned numbers are being used) meets one or more of the criteria of the Board resolution of February 9, 2021, with regard to such option students; THEREFORE, BE IT RESOLVED that the aforementioned student be accepted as an option student on the condition and with the express understanding that all programs, all classes and all buildings of assignment, except as otherwise required by law, shall at all times and from time to time during attendance at Lincoln Public Schools be determined solely by Lincoln Public Schools.

Rationale:

The Open Meetings Act requires and the intention of the Board is that agenda items be sufficiently descriptive to give the public reasonable notice of the matters to be considered at the meeting. The Lincoln Board of Education Board releases its agenda well in advance of most meetings and desires that all interested persons are fully informed. Each year, various federal, state, and local governmental bodies will consider legislative and administrative actions that will have an impact on Lincoln Public Schools. EXPLANATION: In order to communicate the positions of the Board of Education, the Board approves Legislative Guidelines that provide guidance to district staff and representatives communicating with governmental bodies. The following guidelines have been proposed as additions to the legislative guidelines: #15: Empowers the District to provide appropriate compensation and benefits for its employees. #16: Protect the District from litigation, and/or claims against its employees, board members, or the District in general.

Rationale:
According to Neb. Rev. Stat. § 79-533, the board must hold a public hearing on its parental involvement and engagement policy. After the hearing, the Board must either alter and adopt the revised policy or reaffirm it as written.
Explanation: The Student Learning and Technology Committee reviewed Policy 6443 and recommends the current policy be reaffirmed. Proposal: That the Board approve reaffirming Policy 6443.

10.2.1. Woods Charitable Trust Grant Application
Rationale:
Woods Charitable Fund is a private philanthropic foundation created by Frank H. Woods and Nelle Cochrane Woods and their three sons. It was incorporated in Nebraska in 1941 and Frank Woods provided major endowment in 1952 before his death that year. Since that time, the Fund has made grants in Lincoln. This foundation currently operates with a local representative board and is able to respond to the issues, opportunities and creative leadership in our community. Through grants made to eligible organizations, Woods Charitable Fund seeks to strengthen the community by improving opportunities and life outcomes for all people in Lincoln, Nebraska.
Woods supports members of the nonprofit sector who are exploring creative alternatives and promoting more just, effective approaches to meet community needs. Funding is provided in four areas of interest:
Explanation: Lincoln Public Schools would like to apply to Woods Charitable Fund to support partnerships in the community that benefit the Two Generation Family Literacy Program. Family Literacy is a family-centered approach to education that brings children and families together to learn. Participating parents attend their child’s school Monday through Friday, two hours per day. Parents identify educational and career goals, engage in learning English with other parents, and spend time together with their children connecting curricular objectives with family learning activities. A grant from Woods Charitable Fund would allow the program to support new and existing partnerships with organizations in Lincoln that offer education and enrichment to participating families. Proposal: That the Board approve the submission of an LPS application to Woods Charitable Fund to support partnerships in the community for the Two Generation Family Literacy Program. The grant application request will be for up to $75,000 per year for three years, with no match requirement. Application due date: October 31, 2021. |

16. REQUEST FOR CLOSED SESSION
Rationale:
The Lincoln Board of Education is authorized by state statute to hold a closed session by the affirmative vote of a majority of its voting members if a closed session is clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual. The subject matter and the reason necessitating the closed session are to be identified in the motion to close. Closed sessions may be held for, but shall not be limited to, such the subject matter and the reasons set forth in the Proposal section below.

Rationale:
The Lincoln Board of Education is authorized by state statute to hold closed sessions. Closed sessions may be held when clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual. Reasons that meet this standard include but are not limited to: (a) strategy sessions with respect to collective bargaining, real estate matters, pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body; (b) discussion regarding deployment of security personnel or devices; (c) investigative proceedings regarding allegations of criminal misconduct; (d) evaluation of the job performance of a person when necessary to prevent needless injury to the reputation of a person and if such person has not requested a public meeting; and (e) legal advice.
Explanation
At this point, it is appropriate for the Board to meet in closed session for one of the stated matters and/or any other permissible closed session matters in compliance with the law. That the Board hold a closed session: 1. For strategy session with respect to negotiations/collective bargaining clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law. 2.
