Discussion:
Mayor Eickmeier announced that a copy of the Agenda for this meeting is posted on the north wall of the Municipal Building and copies are available on the north wall where a copy of the Open Meetings Act is also posted for public inspection. He also noted that any citizen wishing to address the Council should come to the podium, state their name and address and limit their comments to five minutes. All remarks should be directed to the Mayor/Chairperson, who will then determine who will make any appropriate response. The City of Seward reserves the right to adjust the order of items on this agenda if necessary and may elect to take action on any of the items listed.

Rationale:
This is an Open Meeting of the Seward Nebraska Governing Body. The City of Seward abides by the Nebraska Open Meetings Act in conducting business. A copy of the Nebraska Open Meetings Act is displayed on the north wall of this meeting room facility as required. Disclosure of meeting recording processes is posted in the Meeting Room. A participant sign-in sheet is available for use by any Citizen addressing the Council. Discussion:
The developer wishes to amend the Sub-Division Agreement with relation to the street widths within the development. The Signed Subdivision agreement is attached for review.
Currently the Agreement calls for Spruce and Walnut streets to be built as gravel to a width of 28 ft for access. Later when Pine is paved, the Developer would be responsible to concrete pave both Spruce and Walnut to a width of 32 ft. The City of Seward Unified Land Development Ordinance (ULDO) for Street Design calls out 32 ft cartway width for Industrial and Commercial Uses (see attached). The Subdivider requests that these streets be classified as a rural section, rather than curb and gutter with storm sewer (i.e., a typical urban road configuration). They make note that similar paved streets surrounding this property that are also a rural section; Birch, Cottonwood and Progressive Rd. The ditches and culvert built for the gravel road would remain, leaving just the cost of the pavement which amounts to $146,000.00. The City’s counter proposal follows: Lindner constructs the following, per the approved Mainelli Wagner & Associates plan set: Subgrade preparation, Subgrade fill, Ditches, Corrugated metal drain pipes under Pine St. at both Spruce St. and Walnut St., Detention cell 15-in reinforced concrete pipe outlet for detention cell. Detention cell outlet headwall, apron, flume, and rip rap reinforcement. Pave both Spruce St. and Walnut St. including Cul-de-sacs to 32 ft width of 6-inch gravel. Lindner pays the City $228,000 for future improvements required when Pine Street is paved (see cost estimate attached). The list of improvements include: Concrete storm sewer pipe, Four storm sewer curb inlets, 7-inch concrete pavement with integral curb to 32 ft width, Adjust valve boxes and sewer manholes to new pavement height, Fill, topsoil, seed and mulch in former ditchlines. The City credits Lindner the sum of $10,000 to increase the width of gravel surface coarse from 28 ft to 32 ft. The City credits Lindner the sum of $20,000 to increase the depth of gravel surface course from 2 inches to 6 inches. The City asserts the following: Permanent rural road status will not be granted to Pine St. Spruce St., Walnut St., Cottonwood, or Progressive Avenue. The City intends to pave Pine St., Spruce St., Walnut St., and all other gravel roads within the City limits per the One and Six Year Road Plan.

A Rezone application to change the current zoning from AG (Agriculture) to R-2 (Urban Residential Moderate-Density District) for purposes of reducing the setbacks required for structures.
The subject property is located in an Agricultural District (AG) and involves only the one (1) lot. The current property is located outside the city limits of the City of Seward but is within the Extra Territorial Jurisdiction (ETJ) of the City of Seward. To the Northwest of this property are a number of residences and land that is currently zoned R-2 that are also outside the city limits of the City of Seward but are not connected to the property in review (see attached zoning map). Attached you will find the current setback requirements of the City of Seward Uniform Land Development Ordinance (ULDO) for Rural Residential (RR) and Agricultural Districts (AG) that are set at 25 ft. for side yards and typical of lots outside the city limits. By changing the zoning to R-2 the side setbacks would be reduced to 7 ½ ft. Research of surrounding communities’ setback requirements for acreage lots are also attached for your review.
