Discussion:
Mayor Eickmeier announced that a copy of the Agenda for this meeting is posted on the north wall of the Municipal Building and copies are available on the north wall where a copy of the Open Meetings Act is also posted for public inspection. He also noted that any citizen wishing to address the Council should come to the podium, state their name and address and limit their comments to five minutes. All remarks should be directed to the Mayor/Chairperson, who will then determine who will make any appropriate response. The City of Seward reserves the right to adjust the order of items on this agenda if necessary and may elect to take action on any of the items listed.

Rationale:
This is an Open Meeting of the Seward Nebraska Governing Body. The City of Seward abides by the Nebraska Open Meetings Act in conducting business. A copy of the Nebraska Open Meetings Act is displayed on the north wall of this meeting room facility as required. Disclosure of meeting recording processes is posted in the Meeting Room. A participant sign-in sheet is available for use by any Citizen addressing the Council. Presenters shall approach the podium, state their name & address for the Clerk’s record and are asked to limit remarks to five minutes. All remarks shall be directed to the Mayor who shall determine by whom any appropriate response shall be made. Discussion:
The topic of revising City Code 382-11.1 was broached at the June 7th Council meeting with direction for City Administration to draft an ordinance. A drafted ordinance was presented at the September 6th Council meeting with further guidance to identify restricted streets and requirements for a legal vehicle. Further, the draft presented tonight is unchanged from the September 20th meeting, which could not be considered due to three-fourths of the Council not being in attendance as per Nebraska Statute 17-614. Instead, the ordinance completed a first reading.

2. Consideration of an Ordinance to Amend the City of Seward Unified Land Development Ordinance (ULDO); Chapter 410 Zoning and Subdivision, Article 3.7 'Commercial Use Types'; Article 31.5 'Commercial Uses'; and Chapter 410 Attachment 1 - Building/Zoning & Code Enf Director Dworak

Discussion:
The ordinance presented tonight will amend the ULDO related to commercial use types to accommodate the proposed outdoor exercise area at the Alps Dog Park address. Currently, this use type is not allowed in the Central Business District (CBD), thus with passage of this ordinance it will now be allowable only with the approved issuance of a special use permit to the owner of the property. The public hearing occurred on September 20th; however, the ordinance could not be considered because three-fourths of the Council was not in attendance as per Nebraska Statute 17-614. Instead, the ordinance was read by title for the first time.

3. Consideration of a Special Use Permit for 511 Bradford Street to Allow an Outdoor Dog Exercise Area in the Central Business District - Building/Zoning & Code Enf Director Dworak

The Special Use Permit can only be approved if Ordinance 2022-17 is passed. This will allow Scott Dinslage, owner of Alps Dog Park, to operate an outdoor exercise yard as presented.

The ordinance presented will amend the ULDO related to sign regulations. The ordinance will clarify the allowance of certain sign types for various uses. City Administration is requesting the ordinance be implemented following the November general election. The public hearing occurred at the September 20th meeting; however, due to three-fourths of the Council not being in attendance as per Nebraska Statute 17-614 it could not be considered for passage. Instead, it was read by title for the first time.

5. Consideration of an Ordinance to Amend City Code 350 'Taxation', Article 2.1 'Occupation Tax', Item I 'Sewer Utilities' - City Administrator Butcher

Discussion:
In review of the funding to complete the Seward Wastewater Treatment Plant Construction Project, it was identified that moving the occupation tax from 5.0% to 0.0% would serve as a means to increase funding for the project. As such, the ordinance presented tonight would eliminate the occupation tax on sewer utilities as denoted in the approved FY2022-2023 budget. The ordinance was presented at the September 20th meeting, but due to three-fourths of the Council not being in attendance as specified in Nebraska Statute 17-614, it could not be considered for passage. Instead, the ordinance was read by title.

6. Consideration of an Ordinance Amending the Comprehensive Pay Plan, Providing for a 5.0% Cost of Living Adjustment for All Pay Lines and Incorporation of Comparability Pay Adjustment for Various Employees - City Administrator Butcher

Discussion:
As approved at the August 16th Council meeting, the approved FY23 budget include a 5.0% cost of living adjustment for all established positions as well as comparability adjustments for selected positions. The ordinance presented tonight will establish the FY23 pay lines per position. Additonally, a few errors in job title were identified, a few obsolete positions were eliminated, and the revised Library Assistant I job description is presented for consideration.

7. Consideration of an Ordinance Amending the Municipal Code; Initiating a Sewer Rate Adjustment Increasing Total System Revenues by 15.0%, Effective with October 2022 Billing - City Administrator Butcher

As included in the approved FY23 budget on September 6th, the sewer rates are increased by 15% as of October 1st. After receiving guidance from the City Auditor, Administration presented this option as a means to fund the Wastewater Treatment construction project.

8. Consideration of a Sale Agreement with Stryker Sales, LLC for Two Stryker Cot Lift Systems and Authorization for Mayor to Sign All Documents - City Administrator Butcher

Discussion:
The Seward Volunteer Fire Department was scheduled to order a new Stryker cot system to load patients into our rescue squads. Assistant Chief Dan Brumm after speaking with the representative learned that the Styrker system will be going up 9% in the near future. The sales representative knew that we planned to order another system in FY 2023-2024 and offered to finance two systems and to install both this year if we signed up for them now. Half of the payment would be due in FY 2022-2023 and the second payment in FY 2023-2024. Brumm consulted with the Finance Department and it was recommended to purchase both systems pending approval by the City Council. The City Council approval would not necessarily be needed for budgeted items, but since the financing agreement will obligate a future council, we felt it was important to have their consideration first.

9. Approve Specifications, Plans, and a Cost Estimate for the E Seward Street Construction Project and Authorize the City to Advertise for Bids - City Engineer Oneby
