Discussion:
Mayor Eickmeier announced that a copy of the Agenda for this meeting is posted on the north wall of the Municipal Building and copies are available on the north wall where a copy of the Open Meetings Act is also posted for public inspection. He also noted that any citizen wishing to address the Council should come to the podium, state their name and address and limit their comments to five minutes. All remarks should be directed to the Mayor/Chairperson, who will then determine who will make any appropriate response. The City of Seward reserves the right to adjust the order of items on this agenda if necessary and may elect to take action on any of the items listed.

Rationale:
This is an Open Meeting of the Seward Nebraska Governing Body. The City of Seward abides by the Nebraska Open Meetings Act in conducting business. A copy of the Nebraska Open Meetings Act is displayed on the north wall of this meeting room facility as required. Disclosure of meeting recording processes is posted in the Meeting Room. A participant sign-in sheet is available for use by any Citizen addressing the Council. Presenters shall approach the podium, state their name & address for the Clerk’s record and are asked to limit remarks to five minutes. All remarks shall be directed to the Mayor who shall determine by whom any appropriate response shall be made. 1. Consideration of a Claim from Katherine Krause, 709 N 4th Street, for Tree Removal by Lincoln Tree Service - City Administrator Butcher

On October 17th, the City received a claim from Katherine Krause located at 709 N 4th Street in regards to reimbursement for the removal of a City tree. For consideration will be the approval or disapproval to pay the claim as presented.

2. Approval of Professional Engineer's Recommendation to Award a Construction Contract to General Excavating for the Karol Kay Box Culvert Project and Authorization to Enter into Negotiations with General Excavating - City Engineer Oneby

Discussion:
Bids were received for the construction of improvements related to the Karol Kay Box Culvert project on October 18th. The City received four bids before the deadline with General Excavating (GE) being the lowest at $243,862. Upon consideration from City Engineer Oneby and Schemmer Engineer Alex Roth, the City engineer and project engineer are recommending negotiation of a contract with General Excavating (GE) to complete the project.

3. Approve the Request for Qualifications for the Seward Interior Drainage and Pump Station Improvements Project and Authorize the City to Seek Written Statement of Qualifications for Final Design Services - City Engineer Oneby

Discussion:
The City has been awarded a Hazard Mitigation Grant Agreement from the Nebraska Emergency Management Agency (NEMA) to complete a final design for the Seward Interior Drainage and Pump Station Improvements Project. As such, the City is now ready to advertise to collect a written statement of qualifications from firms to complete the final design.

4. Consideration of a Resolution Authorizing the Mayor to Sign the Annual Year-End Certification of City Street Superintendent - City Administrator Butcher

Discussion:
At the November 16, 2021, Council meeting, Julie Ogden of JEO Consulting Group was designated as the City's Street Superintendent for 2022. The resolution presented tonight will allow the Mayor to sign the year-end certification of street superintendent and allow for the City to submit to the State of Nebraska to remain in compliance.

In preparation for the 2023 Street Superintendent Certification, the City will need to designate a licensed Street Superintendent to remain in compliance with the State of Nebraska. As has been done in previous years, Julie Ogden of JEO Consulting Group has agreed to be designated as the City's Street Superintendent for 2023.

5. Consideration to Approve the Amended Injury and Illness Prevention Program Plan - City Clerk Bargmann

Discussion:
To ensure compliance with Nebraska Revised Statutes 48-443 and 48-446, the City established a Safety Committee and Injury and Illness Prevention Plan on December 21, 1993. Upon review, it was determined that this plan had not been updated since that date; therefore, with the assistance of the Safety Committee, City Clerk Bargmann has drafted a revised, modern version. The updated Illness and Injury Prevention Plan was unanimously approved by the Safety Commitee at their October 20th meeting.

6. Update on the Wellness Center

City Administrator Butcher will provide the latest updates in regards to construction of the Wellness Center. The highest scored three firms from the Final Design RFQ submission will be invited to interview in November with a final recommendation to occur in December.
