Discussion:
Mayor Eickmeier announced that a copy of the Agenda for this meeting is posted on the north wall of the Municipal Building and copies are available on the north wall where a copy of the Open Meetings Act is also posted for public inspection. He also noted that any citizen wishing to address the Council should come to the podium, state their name and address and limit their comments to five minutes. All remarks should be directed to the Mayor/Chairperson, who will then determine who will make any appropriate response. The City of Seward reserves the right to adjust the order of items on this agenda if necessary and may elect to take action on any of the items listed.

Rationale:
This is an Open Meeting of the Seward Nebraska Governing Body. The City of Seward abides by the Nebraska Open Meetings Act in conducting business. A copy of the Nebraska Open Meetings Act is displayed on the north wall of this meeting room facility as required. Disclosure of meeting recording processes is posted in the Meeting Room. A participant sign-in sheet is available for use by any Citizen addressing the Council. Presenters shall approach the podium, state their name & address for the Clerk’s record and are asked to limit remarks to five minutes. All remarks shall be directed to the Mayor who shall determine by whom any appropriate response shall be made. The City of Seward reserves the right to adjust the order of items on this Agenda if necessary and may elect to take action on any of the items listed.

2. Consideration of a Memorandum of Understanding with Tallgrass Development, Inc., for a Blight Study for Property Located at 534 N 10th Street - City Administrator Butcher

Discussion:
The City of Seward was approached by Tallgrass Development, Inc., to perform a blight study on property located on the southwest corner of the intersection of 9th Street and Lincoln Street, legally described as Lots 1 & 7, All Lots 2-12 & Vac Alley, H M & R Addition, Block 100, Seward, Seward County, Nebraska. This is similar to the agreement with Plex Homes for the blight study on the apartments near Concordia University along N Columbia Ave. The City has checked with RDG Planning and Design, and do not believe the costs will exceed $4,000 for this study. The City is not obligated to designate the blighted area, only to perform the study should we enter into the agreement.

3. Consideration of a Request to Allow for the Construction of a Fence in the City Right-of-Way at 353 S 3rd Street - Building/Zoning & Code Enf Director Dworak

Kyle Peterson, Plex Construction, has requested the erection of a fence to surround gas piping that protrudes the ground in the City right-of-way. It is believed that construction of this barrier will dissuade individuals from tampering or climbing onto the structures.

4. Consideration and Approval of Bid Documents for the Park Ave/Bradford Street Storm Sewer Improvements Project and Authorize the City to Seek Construction Bids - City Engineer Oneby

Discussion:
Presented tonight are the final plan and contract sets as drafted by the City's professional engineer (Schemmer) for the Bradford/Park Street Storm Sewer Improvements Project. If approved, the City will begin advertisement to receive bids for construction and will update the Council at a future date.

5. Consideration and Approval of Bid Documents for the Water Tower Construction Project and Authorize the City to Seek Construction Bids - City Engineer Oneby

Discussion:
The City had previously advertised to receive bids for all phases of the de-construction and construction of the south water tower project. At time of submission no bids were received; therefore, at the advice of the professional engineer (Olsson) it was determined that the project should be broken out into three items for bid. As such, presented tonight are the plans to bid out the following: existing tank demolition, utility and site work, and construction of the water tower. If approved, the City will begin advertisement for these bids and will update the Council at a future date.

6. Consideration of an Agreement with B's Sweet Freeze, LLC to Operate a Concession Stand at the Dowding Municipal Pool for the 2023 Season - City Administrator Butcher

The City entered into agreement with B's Sweet Freeze LLC to operate a concession stand at Dowding Municipal Pool for the 2022 season. For consideration is a renewal of the agreement to allow the vendor to operate a concession stand for the 2023 Dowding Municipal Pool season.

7. Update on the Wellness Center - City Administrator Butcher

Discussion:
City Administrator Butcher will provide the latest updates to the Wellness Center project. The Seward Changing the Game Committee is currently doing site visit and viewing floor plans. The City will also review construction-manager-at-risk submissions the week of 2/20.
