Discussion:
Mayor Eickmeier announced that a copy of the Agenda for this meeting is posted on the north wall of the Municipal Building and copies are available on the north wall where a copy of the Open Meetings Act is also posted for public inspection. He also noted that any citizen wishing to address the Council should come to the podium, state their name and address and limit their comments to five minutes. All remarks should be directed to the Mayor/Chairperson, who will then determine who will make any appropriate response. The City of Seward reserves the right to adjust the order of items on this agenda if necessary and may elect to take action on any of the items listed.

DISCLOSURE OF OPEN MEETINGS ACT & OTHER NOTIFICATIONS

Rationale:
This is an Open Meeting of the Seward Nebraska Governing Body. The City of Seward abides by the Nebraska Open Meetings Act in conducting business. A copy of the Nebraska Open Meetings Act is displayed on the north wall of this meeting room facility as required. Disclosure of meeting recording processes is posted in the Meeting Room. A participant sign-in sheet is available for use by any Citizen addressing the Council. Presenters shall approach the podium, state their name & address for the Clerk’s record and are asked to limit remarks to five minutes. All remarks shall be directed to the Mayor who shall determine by whom any appropriate response shall be made. The City of Seward reserves the right to adjust the order of items on this Agenda if necessary and may elect to take action on any of the items listed.

Discussion:
The City allows for the submital of claims for any citizen who feels the City is liable for damages caused by City operations. Claims may be considered by the Council at the discretion of the Mayor. The following claim was brought for consideration, with the claimant being informed as such. The Mayor may, at his discretion, allow the claimant to speak.

2. Consideration of an Agreement with B's Sweet Freeze, LLC to Operate a Concession Stand at the Dowding Municipal Pool for the 2024 Season and Beyond - City Administrator Butcher

B's Sweet Freeze operated the pool concession stand during the 2023 season. Both parties wish to continue the relationship for the 2024 season and beyond.

3.A. Consideration of a Resolution to Adjust Reconnect Fee for Electric Services

Discussion:
In a review of the established reconnection fees for electric services, it was determined these fees did not adequately recoup City costs to perform these services. As such, it was the recommendation of the Personnel, Audit, and Finance Committee to revise fees to $20 during regular business hours and $100 outside these established hours. This change will go into effect with the April 2024 billing cycle.

3.B. Consideration of a Resolution to Establish a Water Service Reconnect Fee

Per City Code Chapter 390-1.28, the City may establish fees for reconnection of water service as set by the Council. A search determined no fee had ever been established; therefore, Administration calculated a fee that would recoup City labor costs if these services were performed during regular business or outside established hours. This change will go into effect during the April 2024 billing cycle.

4. Consideration of a Resolution to Establish a Policy for Insufficient Payment Processing and Reconnection Process - City Administrator Butcher

In review by City Administration and the Utility Office, it was determined a formalized policy had never been adopted by the City Council in the handling of insufficient payment and reconnection of service. Consequently, the attached policy would establish a clear policy to guide these situations. This policy will be added to the website to allow for transparency with customers.

5. Consideration of an Amendment to Extend the Contract with Southeast Nebraska Economic Development District (SENDD) for CDBG 21DTR011 - City Administrator Butcher

The current contract with Southeast Nebraska Development District (SENDD) currently ends on April 25, 2024, for administration of CDBG 21DTR011. As such, both parties wish to extend the agreement by an additional six months to complete the project.
