Discussion:
City Administrator, Tom Ourada, recommended it, as it is a yearly City Maintenance Agreement. There was no further discussion.

Discussion:
City Administrator, Tom Ourada, explained how a portion of that alley was vacated with the Burlington Estates Plat, leaving a lot in a half stranded. This Ordinance will vacate that portion of that alley, but maintain utility rights.

3.C. Council review of City Administrator Tom Ourada representative vote on the Fourth Amended and Restated Articles of Incorporation. 
Discussion:
City Administrator, Tom Ourada, discussed that this is the amended or new Schedule M Agreement. This gives us the choice to carry through with the old Scheduled M or to go through with the new, improved, amended Scheduled M. City Administrator, Tom, stated he would vote for the new Schedule M.

Discussion:
City Administrator, Tom Ourada, explained that Mike Rogers and our City Attorney worked on this ordinance, and it is part of the package of what is being done, and the terms are ok.

Discussion:
City Administrator, Tom Ourada, explained this agreement that Nestle does not exceed cost with a 10% adder. City Administrator, Tom, stated that he feels comfortable moving forward with this agreement.

Discussion:
City Administrator, Tom Ourada, explained how putting a controlled intersection at 15th and Glenwood Ave, with stop signs going both ways, would allow pedestrian crossing. City Administrator, Tom Ourada, did clarify that the school did not ask for this.

Discussion:
City Administrator, Tom Ourada, explained how, outside of Westwood, this is the highest need in the City for a paving district. This area will all be completely redone and sidewalks should also be included in the design. City Administrator, Tom, also explained that he has spoken to some of the major property owners that would not protest it.

Discussion:
Mayor, Dave Bauer, discussed how he would rather go with JEO rather than with Olsson for City Engineer through 2024. Mayor, Dave, stated that JEO grant person is very highly recommended throughout the state. Mayor, Dave Bauer, and City Administrator, Tom Ourada agreed, after looking at upcoming projects, that JEO would be the better one for those upcoming projects.

3.I. Discussion of acquisition of Norris customer conforming with NPRB regulations.
Discussion:
City Administrator, Tom Ourada, explained how this location had been annexed and asked Norris to request to take it over. The City is to pay Norris to take over the customer's property. City Administrator, Tom Ourada, stated this is something we have to do and proceed with.

Discussion:
City Administrator, Tom Ourada, explained how the Street Department has rates for some things, but not for some equipment, such as pick-ups. Pick-ups are just being added to rates.
