3.B. Variance Request for 1165 Lakeshore Drive 
Discussion:
Alan and Patricia Erikson addressed the City Council and stated the the regulation fence would obstruct the view from 2 large back windows looking into their back yard. The would be looking at a fence 5 feet from their windows. 

Building Inspector Trent Griffin stated that there have been cases where property owners had to move their fences. 
City Administrator Tom Ourada stated that variances can't be allowed if there is not a hardship. If something is allowed and there is no hardship that opens up for lawsuits in district court. 
Patricia Erikson stated that their hardship is that the fence being so close to the house would decrease the value of the home. However, the Board of Adjustment stated to Erikson that it was their choice to put the fence up. 
City Attorney Anna Burge stated that by State Statute the applicant must prove that the zoning regulations would produce undue hardship and that each of the 4 conditions have been fulfilled. There has to be facts for each of the 4 conditions if approved. 

Randall Shelton motioned and Colten Mach seconded to deny the Variance Request for 1165 Lakeshore Drive.
