5.a. Public Hearing for the purpose of considering the proposed annexation of Gage County Parcel No. 004240000, and Gage County Parcel No. 004241200 now platted as Lot Two (2) Haner Subdivision, Gage County, Nebraska, owned by the Beatrice Cemetery Association.

Discussion:
TT - annexation of Cemetery on east side of town. talked about last meeting. passed resolution setting PH, read by ordinance number at 3 separate meetings & wrap up the end of June. Answered all questions Cemetery had, no concerns or calls from public. Ruh - explain 33rd Street. TT- part in City, part in County. make cleaner easier to annex & city owns. Cemetery is developed as much as it will be, feel good time to bring into community. KErr - all up to BSDC is all in CIty limits correct? TT - yes, all taken in within last decade.

Discussion:
Lot 1 DeBoer's addition - S Sumner & Belvedere, DeBoer Trust owned ground, acquired city owned property, vacated & transferred to DeBoer Trust, now part in city limits, part out. proposing to annex those parcels. broken into 2 parcels, Tim - who else owns past this spot. WHy not use on this street. TT - Urban or Suburban in nature, water/wastewater/electricity, some do provide utilities, not all provided san sewer., Tim- do they want to be annexed? TT - not sure they want to be but have addressed those concerns. Chase DeBoer does not want annexed in want to know why bringing in to CIty.. GB - were they notified? TT - yes. TD - have they been discussed. TT - this is not something feasible moving forward. Tim - how many others are in same situation? TT 1/2 in 1/2 out none

Public Hearing for the purpose of considering (i) the rezoning of Parcel No. 005039000, commonly known as 2876 West Belvedere Road, less that portion thereof now platted as Lot One (1), DeBoer’s Addition, Gage County, Nebraska, from “AG” Agricultural District to “RR” Rural Residential District; and (ii) the rezoning of that portion of Parcel No. 005039000, now platted as Lot One (1), DeBoer’s Addition, Gage County, Nebraska, from “AG” Agricultural District to “R-2” Single-Family Residential District.

Discussion:
same parcels, part of annexation rezone, were zoned AG, rezone farmstead to R2, which is what is to east of location. larger portion is RR, not alot of AG within city limits. whether in or out, still falls within our zoning rules as they are within 2 mile zoning. housing didn't qualify as AG, so R2 made most sense. new owner for larger portion, RR made sense.

Resolution Number 7314 executing the Substitution of Trustee, General Release, Request for Reconveyance, and the Deed of Reconveyance, along with all other necessary documents to terminate the Deed of Trust release and discharge Hybrid Turkeys, LLC, regarding the LB840 Loan Agreement between the City and Hybrid Turkeys, LLC.

LB840 loan 6 years ago, every year remain inside city, have forgiven 6% of loan. working on corporate refinancing, want DOT removed. repaid $40,000, release DOT, etc

Resolution Number 7315 executing the Grant Agreement with Main Street Beatrice, Inc., whereby City will provide Main Street with the Match Funds required by the from the Nebraska Department of Economic Development’s (NDED) Rural Workforce Housing Investment Program to establish a revolving loan fund to develop workforce housing in the City of Beatrice.

Discussion:
not having de ja vu, discussed couple weeks ago, required matching funds, in agreement provision to pay back to CIty, State said we cna't do that, new agreement removes requirement to repay any funds back to City. We have seat at committee to award funding.

8. PUBLIC FORUM
Discussion:
paul fanning, 522 helen street, left leg bit by dog walking on sidewalk in neighborhood. was able to verify the dog was up to date on rabies shots, seem to have dogs running at large, often in parks running free, not concerned about his dogs to cause issues. concerned with others not taking care of their dogs. see other dogs owners not following rules to keep under control. concerned for what may happen. dog fight, owners or dog getting shot, didn't make report, wish there was something that could be done to ensure all in public are safe from dogs running at large. doesn't have suggestions or know best way to handle this. do we ask PD to be more active would feel silly to get calls for service about dogs. hope council can come up with something to bring public notice before something serious happens.

9. DISCUSSIONS/REPORTS

9.a. City Administrator's Monthly Report.
Discussion:
trail out to homestead - continue to work on alignment to homestead, homestead & city did't like, now NDOT doesn't like. looking at 2027 for construction. 33rd & Lincoln, mid June start date, still need pre-construction meeting to be set up. waterfall will be getting additional flagstone seating area. notified today we received another SS4A grant, this MM wrote for us for our ADA transition plan. looks at all parks, buildings, here is a list of items that need to be improved to become ADA compliant. last in 1995?? Have to have current ADA transition plan for federal grants. 20% match, last SS4A grant took Feds 1 year to send contract...that's why we went for it, needed to be up to date, MM came through & got it for us. TEd - money for shelter at dog park, looks like it is ready to be constructed? Mark has summer kids showing up. Holes dug & footings look ready. TT - should have up within 2 weeks.
Terry - received 2 calls on Tiemann Construction 13th STreet project, both positive. had dealing & were treated very well, moving along with it & are doing a good job. $____, ambulance? Wait time? TT - 9mo to 1 year before . each has different timeline. |

10.a. The next regular City Council meeting is June 3, 2024 at 7:00 p.m. in the BPS Administration Building Board Room. There will be a Work Session on June 17, 2024 at 7:00 p.m. in the BPS Administration Building Board Room.
